Pushtank
Terms of Use

The French version is the one that binds. This English text is provided for convenience only; where the two disagree, the French prevails.
These terms govern the use of Pushtank. Installing the app means accepting them.
Publisher: Biga Studio, a French société par actions simplifiée with share capital of €1,000, registered with the Paris trade register under number 918 273 645, with its registered office at 12 rue de la Paix, 75002 Paris, France. Pushtank is a trademark of Biga Studio.

What the product does
You choose apps to block. They stay blocked while your tank is empty. Physical effort fills it: push-ups counted by the camera or the sensors, walking, running. The time you earn is spent by using the apps, and drains while you use them.
You set what your own effort is worth, between the rate the catalogue proposes and the ceiling it defines. That is your setting, not ours.
Time credited to your tank does not expire, and we do not take it back. Three rules of the game can still cost you repetitions, and the app tells you each time one applies:
- the tank has a ceiling, and anything earned past it is lost;
- a stake put up in a duel is withheld for the duel's duration and goes to the winner — losing the duel means losing the stake. If the duel never happens, though, your stake comes back: a challenge nobody takes up, one somebody else answered first, or one that expired before you gives you back what your set was worth;
- time taken in advance is repaid with a surcharge, out of what you earn next;
- duel winnings are capped per day, and anything above the cap is lost.
There is no account
No sign-up, no password, no email address, and nothing to sign in to. Your profile is minted on your phone at first launch.
Your tank, your history and your settings live on the device, and the server holds a copy it will not hand back: we offer no restore. On an empty phone everything starts from nothing and only the purchase returns, through the App Store — but your iPhone's own backup carries this data like any other app's.
The purchase
Pushtank unlocks through a purchase made through Apple's App Store. We collect no money ourselves and see no payment details.
- The yearly plan is an auto-renewing subscription. It is managed and cancelled in your Apple account settings, not with us: there is no account to cancel here and no email to unsubscribe from.
- The free trial is an introductory offer, and the App Store decides who gets one — by your Apple account's eligibility, not by what any screen says. Somebody who has already used theirs is charged at purchase.
- The lifetime plan is a single payment: it does not renew, there is nothing to cancel, and it opens no trial.
- Prices and trial length are those the App Store shows at the time of purchase, in your currency.
- Refunds are Apple's to grant under Apple's rules. We can neither grant nor refuse one.
What the purchase does not condition. Nothing blocks while no purchase is in force, and nothing keeps blocking once one stops: a lapse in payment lifts every restriction. Unlocking and erasing stay free, always, purchase or no purchase.
The way out
Two separate gestures, and neither is behind the payment:
- Unlock everything immediately lifts every restriction Pushtank has placed on this phone, and tells you what was removed.
- Delete my account erases the profile on both sides — phone and server — immediately, with no going back and no delay, since there is no account to recover. Without a network, the phone is erased straight away, and the server as soon as it answers: the app asks it again at every launch. The screen returns a receipt of what left.
Cancelling the subscription is a third gesture, and it is not ours: it is bought through the App Store and cancelled in the App Store. Deleting your account does not stop it, and we cannot stop it for you — deliberately, so that coming back lands on an empty profile rather than a paywall.
Uninstalling the app removes what it placed on the phone.
What you undertake
Count honestly. The app judges the quality of repetitions and may refuse some; trying to fool it — shaking the phone, filming a screen, having somebody else counted — is not an intended use and may lead to suspension from duels.
In a duel you are visible to your opponent under the pseudonym you chose. Choose one that hurts nobody. We may remove an abusive pseudonym.
You must not try to circumvent the software's protections, reach anybody else's data, or disrupt the service.
What the product does not promise
Pushtank counts repetitions with a camera and sensors. It is not a medical device, and the count can be wrong in either direction.
It is not a training programme and nothing here is medical advice. You exercise under your own responsibility, at your own pace, and it is for you to seek medical advice if you are unsure. Stop if it hurts.
Blocking rests on iOS's Screen Time mechanisms. It discourages; it is not an unbreakable lock, and we do not guarantee that somebody determined to get around it cannot — including you.
The service is provided as is. We do what is needed to keep it working, without guaranteeing uninterrupted availability or freedom from defects. Our liability is limited so far as the law permits; nothing here excludes liability that cannot be excluded.
Duels between two people
A live duel makes the two phones communicate directly. Your opponent may therefore learn your IP address. If that bothers you, play asynchronous duels.
Changes
These terms will change as the product changes; the date at the top says when. A substantial change will be announced in the app before it takes effect. Continuing to use Pushtank afterwards means accepting it.
Governing law
These terms are governed by French law. In the event of a dispute an amicable solution will be sought first.
No clause forces a court on you: if you are a consumer, jurisdiction is what the law gives you, and that includes the courts where you live. You may also refer the matter free of charge to a consumer mediator.
